Even when funding helps, it can add layers:
1) Lien/payoff coordination
Some funding agreements require repayment directly from settlement proceeds, and your lawyer may have to coordinate payoff amounts at closing. Some legal commentary notes attorneys may worry about administrative burdens or strategy impacts.
2) Multiple advances
If you take multiple advances from multiple funding companies, repayment math can get messy fast, and net recovery can shrink.
3) Misunderstanding “risk free”
People hear “risk free” and assume there is no downside. Non-recourse terms may protect you if you lose, but the cost can still be substantial if you win.
That’s why it’s vital to prioritize transparent contracts and ask direct questions about cost growth over time.
